AIGETOA made submission before CGMT Kerala with regard to proper attention towards BSNL service maintenance at Lakshdweep islands. Employees working at islands are under severe stress due to manpower reduction and delay in replacement / repair of cards / powerplants which is essential. We hope that immediate remedial response by Kerala circle administration will be there and measures will be initiated to address the pathetic situation of employees and for a special fund / sanction for Lakshadweep for upkeep of communication network since Lakshadweep is an important strategic location concerning national security.

As per agenda submitted by us, meeting with office bearers of AIGETOA took place with Director (HR) on 16th November 2019. Association side was represented by General Secretary Shri Wasi Ahmad, All India President Shri Ravi Shil Verma, Vice President Shri Badri Kumar Mehta, AGSs Shri Yogendra Kumar and Shri Sunil Gautam. From Management Side, Director (HR) was present along with his Team consisting of PGM (Pers) Shri Arun Kumar, GM Recruitment Ms Shamita Luthra, DGM (Pers) Shri Lal Singh, DGM Establishment Shri Shiv Shankar Prasad, AGM (Pers-Legal) Shri Uday.
The meeting was called by the Director HR on Saturday for a detailed deliberation on agenda items and lasted for more than two and half hours. Highlights of the discussions are as stated below:
1. JTO to SDE promotion through SCF and LDCE: We emphasised that despite assurance from management, till date the DPC process of JTO to SDE has not started. Personal section put forth the arguments that due to pendency of judgment in review petition filed by BSNL in Hon'ble High Court, promotions are not possible. We informed Director (HR) that the review petition is not at all a show stopper as the Hon'ble Court has categorically told that there is no need to review the judgement and whatever that Hon'ble Court has judicated stands true and the same does not require any modification. Review petition was filed by management as well as other associations just to delay the process and nothing else. Therefore, citing review petition as the cause for delay is not correct. We also explained the circumstances under which applicants were forced to file court case, how the contempt happened and what were lacunae in the process adopted by BSNL, which ultimately resulted in contempt of court. Director (HR) was appreciative of our concern and he was of clear view that there should not be any reason to delay the promotions and even if there is court case, same should not be made a reason to stop the process. Director (HR) directed PGM Pers to initiate the process. PGM Pers told that a legal opinion shall be required to initiate the action on DPC. Director HR told that the needful may be done to ensure that promotions are not delayed any more and legal hurdles should not come into the way of promotions. We further requested Director (HR) that current vacancies as on date should be filled up so that maximum persons get the benefit of the promotion. The Director (HR) clearly told that he is not averse to any promotion i.e. SDE, AGM, DGM if it comes within ambit of proposed HR plan, which is under advance discussion. We categorically informed that we are also not averse to any promotion but the JTO to SDE DPC is longest pending due and should be ensured first prior to others.
We also requested for issuance of LDCE notification. GM Recruitment was asked to explore the possibility of early notification.
2. SDE to JTO Reversion issue of LDCE-2007: The matter was discussed and deliberated in detail and association side strongly put forth points in the light of the existing provisions of 12(5) of the SDE RR as well as service rendered by the candidates in SDE cadre. Finally, it was agreed that the matter will be considered once the replies are received from all candidates and put up for direction to Director (HR). We argued for a considerate decision in this regard to the Director on which he responded positively.
3. Circulation of provisional of list-9 and final list-8 of SDE Seniority: It was informed by PGM Pers that before circulation of provisional list 9, finalisation of list 8 is a mandatory exercise. We told that that the provisional list was circulated way back and why it is taking so long to finalise both the lists. The PGM Pers informed that provisional list-9 will be circulated within a month time. The Director (HR) emphasizes to follow the time line. We also requested that since list 9 has not been prepared yet and that the matter of retrospective amendment of SDE RR has been passed at MC level and pending at Board Level, accordingly the list 9 should be prepared as per the provisions of Rota-Quota i.e. in ratio of 2:1 amongst SDEs from SCF and LDCE quota. PGM Pers has reservation and reluctant to the line of preparing the list in 2:1 ration due to pendency of approval by Board. We categorically told that when management committee has already approved the retrospective amendment in SDE RR, there is no reason of not preparing the list in 2:1 ratio. On our insistence, he agreed to examine it on merit.
4. Standard Pay Scale and Pay Loss: We informed the current status of the Pay Scale issue and told that the issue is pending at DoT Level. We also told that since the scales of MTNL and BSNL are different, it is high time that DoT approves BSNL proposal for the implementation of Standard Pay Scales of E2 for JTO and E3 for SDE grades which are still kept at Provisional scales. It was also briefed to the Director that the scale of JTO/JAO equivalent starts with E2 in MTNL and so it is important to implement E2-E3 in BSNL for smooth implantation of BSNL-MTNL merger. We requested Director (R) to send a reminder letter to the DoT for early favourable approval. The Director (HR) assured that he will take up the matter with DoT. We also requested for sympathetic consideration of the pay loss issue of the JTOs recruited post 1.1.2007 in E1A scales. However, Director (HR) was non-committal on this issue.
5. 30 percent SAB issue: Director (HR) told that the current financial situation of the company does not permit any increase in SAB as of now. We said that when such a huge package has been offered by government to ensure BSNL Revival, this long pending issue of 30 Percent SAB should also be considered now. Director (HR) told that he will definitely consider increasing the SAB contribution once the financial position of the company improves. We requested Director (HR) that since the increase has been assured at the level of CMD, BSNL management should try to ensure that the increase of another 3 percent comes with implementation of revival package. We also told that the SAB contribution is due from the date of our appointment as per Gazette notification of BSNL and accordingly the deficit contribution of the earlier years should also be contributed. Director (HR) said that the youngsters should concentrate on bringing BSNL to profit post VRS scenario and all such issues shall be taken care by the management with positive balance sheet.
6. Post retirement Medical Benefits (PRMB) for existing BR and those opted VRS: Director (HR) was quite categorical on this and agreed that PRMB fund should be there in place to ensure that the BSNL Recruits are covered under Medical Scheme. On the contention of establishment section that BSNLMRS takes care of the post retirement medical benefits, Director (HR) himself told that there should be a defined contribution scheme as if in future BSNLMRS scheme is closed, what will happen to the BSNL Recruits? It was agreed to explore the possibility of creating this fund as soon as possible.
7. Scrapping of MT RR- Introduction of Fast Track for the post of AGM/DGM: Director (HR) was in concurrence with our idea of fast track promotions and said that the promotion policy should be aimed at bringing the meritorious, qualified and performing executives further up in the order.
AIGETOA submitted an HR Proposal, "BSNL Promotion Policy for Executives" having a provision of time bound promotion till AGM/CAO/Equivalent and Post based promotion from DGM/Equivalent onwards with a provision of FAST TRACK Mechanism at each level i.e. SDE, DET and DGM. 8. Submission of proposal to handle post VRS situation including HR Restructuring: We presented a proposal on the subject to handle post VRS situation and gave inputs collected from field units in the presentation form. We also submitted our proposal of the HR restructuring which deals with total numbers of executives and post wise new sanctioned strength as per the new dimension of BSNL as well as to cater the need of future promotional aspiration to the remaining executives post VRS. We have emphasized in the proposal that at least 40000 to 45000 total strength of executives should be ensured in the restructuring to cater the operational need of the organization as well as providing ample opportunity for the future promotional avenues to remaining executives on post VRS. Director (HR) and PGM (Pers) appreciated hard work done by AIGETOA Team in preparing the detailed presentation and told that we should not worry about the situation post VRS and all due care shall be taken to ensure that operations and maintenance activities do not suffer. He said that our inputs shall be given due consideration and it will be ensured that employees do not face hardships because of sudden decrease in number of employees. Earlier we have already submitted our proposal on all verticals, i.e. CFA, CM, EB to the management. We extend our profound thanks to the Team of Kerala, CTD, Rajasthan and others for their hard works in completing these proposals.
We extend our deep gratitude to the Director HR for his positive outreach from the initial days of his office and clear stand on the issues. We hope that he will understand the pain of marginalisation of BSNL recruited executives in all promotions affected in BSNL till date. Because in the absence of any action, mere hollow words will not be sufficient to motivate these young, talented but marginalised BR Executives to take burden of post VRS in BSNL. We are supporting the BSNL Revival Scheme including VRS from day one and ready to take up challenges but the management has also to reciprocate in the same tone by addressing our basic rights as deliberated above for a balance & bright future of BSNL. Any preferential treatment to any other group by ignoring the rights of BSNL recruits will result into huge unrest and AIGETOA will not remain a mute spectator and will launch organisational activities forgetting all the co-operation.

Kerala Circle is one of the most important circle of BSNL from the time of inception and we need to be equipped to face the responsibilities well in-time with available resources and additional requirements / suggestions need to be taken with Corporate office. We have submitted the suggestions on CFA/EB/CM submitted with Corporate office also with Kerala Circle. AIGETOA has well defined plan with regard to various verticals and modalities that need to be implemented to accommodate the changes and face the business scenario in BSNL. We have the best internal talent pool among any Telecom company and we are sure that further deliberations /ideas /suggestions /discussions will make a turnaround strategy for BSNL inline with aspirations of Government, Customers and employees.

It is learnt that the rejoinder application for E2 Scale for JTO cader, will be considered for final hearing by first week of November-2019 at Hon CAT, Ernakulam.
The clause-10 of JTO RR-14 is already under stay for last 3 years, in the same case.
We are awaiting for the final hearing and further directions.

Our Circle team met CGMT BSNL Dr. P T Mathew, ITS today. We appraised respected CGMT regarding our Circle Conference and expressed our sincere gratitude towards his whole hearted support and trust towards the executives and this association. We introduced the new team and committee. Sri. Saheer S CS Kerala, Sri.Muhammadali MC CP Kerala, Sri.Maxmilan CFS Kerala, Sri.Prasadraj ACS, Sri.Vipal prem VP attended the meeting. CGMT expressed new Circle Committee his best wishes and greetings.
We discussed about SDE to JTO Reversion matter & Transfer /relieving cases. CGMT was very much positive on the approach and assured us earliest solution in the relieving of the executive. In the reversion matter it was informed that, based on the outcome of legal proceedings, maximum help will be extended for the executives.
Further our team appraised about Operational issues in field units, Pending payment to contract Staff, Kfon project, Post VRS scenario etc. CGMT expressed that more and more suggestions related with better business opportunities for BSNL are expected from our side. CGMT stressed on hard work and team effort to build up a better BSNL and we assured that BSNL recruited employees will be delivering the best for organisation as always.

Salient Points approved by cabinet for BSNL-MTNL Revival:
1. Administrative allotment of spectrum for 4G services to BSNL and MTNL so as to enable these PSUs to provide broadband and other data services. The said Spectrum will be funded by the Government of India by capital infusion in these PSUs at a value of Rs 20,140 Cr in addition; the GST amount of Rs 3,674 Cr to this spectrum value will also be borne by the Government of India through Budgetary resources. By using this spectrum allotment, BSNL and MTNL will be able to deliver 4G services, compete in the market and provide high speed data using their vast network including in rural areas.
2. BSNL and MTNL will also raise long-term bonds of Rs 15,000 Cr for which sovereign guarantee will be provided by the Government of India (GoI). With the said resources, BSNL and MTNL will restructure their existing debt and also partly meet CAPEX, OPEX and other requirements.
3. BSNL and MTNL will also offer Voluntary Retirement to their employees, aged 50 years and above through attractive Voluntary Retirement Scheme (VRS), the cost of which will be borne by the Government of India through budgetary support. The ex-gratia component of VRS will require Rs. 17,169 Cr in addition; GoI will be meeting the cost towards Pension, Gratuity and Commutation. Details of the scheme will be finalized by BSNL/MTNL.
4. BSNL and MTNL will monetize their assets so as to raise resources for retiring debt, servicing of bonds, network up gradation, expansion and meeting the operational fund requirements.
5. In-principle merger of BSNL and MTNL.
Our CS Sri.Saheer S ,ACS Sri. Prasadraj and Aravind DFS met GM(HR/Admin) today with regard to SDE reversion matter and relieving of one executive from Trichur BA.
We have once again detailed the reversion matter with administration and mentions the lacunae happened from concerned legal section. As some corners who smile from front are trying negatively in the background. We requested that the statu-quo order from Hon CAT, Ernakulam may be implemented towards executive friendly side and requested management's support to tide over the difficult situation faced by our fellow colleague. Since reversion matter includes some legal formalities, we requested administration to clear the same so as to render justice for affected executives from Kerala also.
