Kochi: The 6th Circle Conference of BSNL Executive's Recognised Majority Association - All India Graduate Engineers and Telecom Officers Association, Kerala Circle Unit was inaugurated by Kerala Circle Chief General Manager Shri.B.Sunil Kumar at P.G.S Vedanta Ernakulam on 17th Dec'2022. The program commenced with the Official Flag Hoisting by AIGETOA Circle President  Shri Muhammadali. The function was presided over by Sri. Muhammad Ali M C, CIrcle President ,  The theme of Open session was - " Role of Management and Employees in BSNL 2.0".

Shri S.Saheer Circle Secretary AIGETOA Kerala delivered the Insights on the Open Session Topic . Elaborate Speeches/ Deliberations was made highlighting the Opportunities and Challenges that are to be handled by employees in the new phase of BSNL which is on  a Revival spree. The meeting was attended by Collegium Members, Office bearers, and other delegates of  AIGETOA Kerala.

During the Circle Conference Event, AIGETOA Kerala Diary and Calender 2023 was formally published by Shri B. Sunilkumar ITS (Chief General Manager, BSNL Kerala).

In Afternoon session  Shri S.Saheer Circle Secretary AIGETOA Kerala presented the Working Report and Shri Maxmillan K Circle Finance Secretary AIGETOA Kerala presented the Financial Report and the house unanimously accepted the reports . Subsequently the existing Circle body was dissolved by Circle president Shri Muhammadali and the house was handed over to Returning Officer Shri Jose Paul and Asst Returning Officer Shri Bijeesh KP , CHQ Observer was Shri S.Suresh, (Joint Secretary South, AIGETOA CHQ).

The house unanimously selected the follwing as Circle Office beaers of Aigetoa Kerala for the term 2022-2025.

The new body took oath from Returning Officer Shri Jose Paul.

The vote of thanks of the event was delivered by New CFS Sri. Pramodh K J , And the Circle conference was concluded by around 6.30 pm.

EPF Joint Form Submission for Enhanced Pension

AIGETOA Circle team have took a legal opinion on the matter of EPF Full Pension option submission. As per Hon SC Judgement dated 4-11-2022, it was directed to EPFO to give the option forms for those who are desirous to give the enhanced pension option based on actual Basic+DA ( pensionable salary ). As the option forms are not shared so far, it will be always better to give an option in this regard at the earliest certified by employee and employer ( BSNL ) and submit to respective RPFO ( For BSNL Kerala Circle it's RPFO is Trivandrum) through BA Establishment section. A sample form is shared here with. We have already appraised the same matter to GM (HR/Admin) and the internal communication in this regard already been sent to BAs. Those who are interested in submission of the forms may do accordingly.

On 30-11-2022, the team comprising of Circle President, Sri Mohammed Ali, Circle Secretary, Sri Saheer, Circle Vice President, Sri Vipal Prem, supported by AIGETOA CO BA team &  TVM BA team, welcomed Sri B Sunil Kumar, ITS, the new CGM BSNL Kerala  with flower bouquet and honoured the Sri C V Vinod, ITS,  CGM Tamilnadu  with memento .

At the outset, Sri C V Vinod, ITS our outgoing CGM, expressed his satisfaction in working with the Team AIGETOA Kerala. He thanked AIGETOA Kerala Team for constantly encouraging the workforce in general and our association members in particular. He also conveyed his best wishes to entire BSNL fraternity in Kerala. We in return replied that our ex-CGM have guided, motivated and supported us by understanding the matters to the root. We thanked him for his great leadership and conveyed our heartiest wishes and prayers to him and his family.  We also mentioned that we considered ourselves privileged and lucky to work under his team and always felt comfortable on each and every matter dealt with.

It is matter of fact that CGMT Vinod Sir had set new standard on role handling and management. We also witnessed a true human being in him who is considerate about fellow colleagues while giving equal importance to our beloved organization. He always strived hard to find solutions for each and every matter in an amicable manner with a personal touch which was incredible.

We also look forward to having a constructive leadership with BSNL Administration at Circle level under the leadership of new CGM Sri B Sunil Kumar, ITS. He is a well known technocrat and we are sure that his technical abilities clubbed with managerial skills will bring new laurels to BSNL Kerala. A Successful organisation needs a satisfied workforce and we are also confident that an empathetic personality like our new CGM will have this larger picture in mind while discharging his duties. AIGETOA Kerala wished him success in his endeavours and extended our whole hearted corporation in matters concerning the welfare of employees and our beloved organisation.

Interactive Awareness Session on EPF Matters

The Interactive Awareness Session organised by AIGETOA in liaison with EPFO Trivandrum held at Conference Hall, O/o CGMT BSNL Kerala on 25/11/2022. The session was handled by Smt. Nisha S , Enforcement officer & Sri. Tojan Enforcement officer from Regional PF Office Trivandrum. The session which started at 3 PM held at Conference Hall had participation of more than 100 participants directly, 97 employees online and more than 250 through YouTube live streaming. The officers from EPFO explained various schemes under EPF/EPS schemes. Employees from all over India participated in the discussion and most of the queries got cleared. The session was addressed by AIGETOA CIrcle Secretary Sri. Saheer S and Circle President Sri.Muhammadali MC. EPFO authorities also stressed on the importance of E-nomination by all members. The meeting lasted for more than two hours and ended with a vote of thanks at 5:15 PM.
We thank our CGMT & GM HR /Admin who are kind enough to allot the conference hall for the program.

Meeting with GM(HR/Admin), Kerala Circle

Inline with our earlier communication with respected CGMT BSNL Kerala and as directed, the meeting with Recognised Representative Executive Association, AIGETOA held today with GM(HR/Admin) on the following matters. Our CS Sri.Saheer & ACS Sri. Prasad Raj represented by association side

1. Processing of Rule-8 Requests

As assured to this association in various formal and agenda meetings, the processing of all pending Rule-8 requests needed to be started on completion of 4 yrs & 9 months. Accordingly it's assured that all the pending Rule-8 requests will be processed and send to concerned outside circles for willingness/acceptance. AIGETOA will be following this matter in those circles also to speed up the matter. As assured to our dear colleagues, we hope that we will be able to get the relieving also on completion of five years accordingly

2. Consideration of Training Centre requests for Phase-1 training

The phase-1 training of LICE JTO batches are scheduled to start from November 28th onwards. Even though there are very few seats allotted in Mysore RTTC, there's a huge request towards Mysore especially from northern BAs. We requested to consider the cases on merit and allot the trainees to their choice of centres to the maximum possible extent. GM HR assured that the cases will be considered and those opt with RTTC Trivandrum will not have any issues in their choice. As far as Mysore RTTC is considered after receipt of all the requests decision will be taken to help the trainees

3. Pending inter BA Request Transfers

We requested to process all the pending inter BA requests as assured to this association after publication of the list. It is assured that the inter BA pending request transfer list will be published and the proceedings for issuance of transfer orders also will be done at the earliest

EPF Pension Case : A relief on Social Security Aspect

Hon'ble Supreme Court of India has delivered the verdict on EPF Pension case after hearing the applicants and the review petitions filed by EPFO & GOI challenging the Hon'ble HC verdicts from Kerala, Rajasthan, Delhi etc.

As already aware team AIGETOA is closely involved in EPFO Full Pension Case for entire BSNL Recruited Employees, who are willing to opt the scheme. AIGETOA Kerala Team had already won the case of EPF Full Pension Scheme against EPFO in Hon’ble High Court of Kerala on 25th Feb, 2019 in WP(C) No 39855/2017, 41071/17 & 3001/18 in line with WP(C) 13120/2015 judgement and other cases won by different applicants in the Hon’ble HC , Kerala. The order of Full Pension Scheme pronounced by the Hon’ble HC Kerala was challenged by EPFO through Special Leave Petition (Civil) in the Hon’ble SC vide Diary No 9610/2019. This SLP of the EPFO was dismissed by the Hon’ble Supreme Court on 01.04.2019. After dismissal of the SLP, the EPFO moved Review Petitions in the Hon’ble Supreme Court, which was pending before the Hon’ble Apex Court. Due to the collective efforts of various applicants and their counsels spread across the country the cases were heard in detail which supported EPF members rights and the judgment is delivered.

Now by utilising the powers exercised in Article-142 of the constitution, Hon Supreme Court has extended the cut off date for allowing the existing members of EPS scheme for the eligibility for Full pension. It is learnt that with this judgment, the Cut off date imposed in EPFO amendment in 2014 is not acceptable and the member can opt for the pension scheme without such cut-off date. The members of EPS scheme who were eligible right through 11(3) option who desire to get the full pension will have the continued right to do so by exercising the option as mentioned in 11(4). The time to exercise option extended for a further period of Four months. Hon'ble SC also observed that the additional contribution (1.16%) as envisaged in 2014 scheme, on the salary exceeding the limit (Rs-15000/- now) to be ultra vires (this portion suspended for six months to enable EPFO to make adjustments/provisions by EPFO). At teh same time the basis of calculation for pensionable salary (60 months average) is not altered.

AIGETOA has always been in forefront of pursuing for the cause of executives. It was AIGETOA which made BSNL realize their mistakes and pursued for correction in the system. AIGETOA and it’s team fought for streamlining the system and forced BSNL to not to recover penalties from employees. All may recall that with continued persuasion from AIGETOA during 2016-2017, BSNL Corporate office had issued letter vide Letter no NO:500-85/CA II/BSNL/EPF/2013/Vol VI Dated 30.03.2017 for collection of options from the employee who desired to opt for full pension. Further since the matter was placed before Hon Court, the same was pending. AIGETOA team filed a separate case to get the relief as the case by NCOA was for exempted which had their own trust like NTPC etc which had potential to rejected also and would have jeopardized the case of BSNL employees which was a non exempted organization where accounts are being maintained by EPFO directly. Our Team won the case at High Court Kerala.

Now, AIGETOA will once again reach out to respected CMD BSNL, Dir (HR) and concerned section, to re-start the proceedings afresh and take necessary measures for final submission of all joint forms to respective EPFOs in order to give the relief to all BSNL recruits who desire to get the social security through the enhanced pension in line with the verdict of Hon’ble Apex Court today. Further, all employees falling under EPF scheme are advised to ascertain from respective BSNL offices that their date of joining in the service remains updated in the EPF ledger as due to transfers of account from one place to another, discrepancies may occur.

Notification for holding of VI^th  Circle Conference and Annual General Meet of AIGETOA Kerala is hereby  issued as per provisions in the constitution of AIGETOA. The conference is scheduled to be held on 17^th December, 2022 at  The PGS Vedanta, Lissie Junction , Ernakulam.

Online nominations will be called for New Circle Governing Body of AIGETOA Kerala from 10^th to 24^th  November 2022  through google form as made available in website www.aigetoakerala.org. Any valid member of the association and member of AIGETOA Kerala Circle can file nomination. The schedule of the election shall be decided by the returning officer in consultation with present collegiums at the venue.
