Truth Prevails...

Finally DoPT 1:1 Seniority case (JTO Cadre) judgment has seen the light of the day. Even though the judgement copy is yet to be received, We truly hope that both Promotee and Direct Recruit JTOs will get their rightful due through this path breaking judgment by Hon'ble HC Ernakulam.

From the information received, the verdict has come as a Win-Win situation to all who aspire to get the first functional promotion. The thing removed was the gluttonous politics from some corners, which made Direct Recruits to suffer for their promotional avenues. Due to this, the BSNL Recruits lost the promotion chances to SDE cadre from 2005-06 onwards, even though clear guidelines were there from DoPT, DoT & BSNL. Had justice been delivered a few years ago, the Promotees also would have moved up in their career ladder along with Direct Recruits long back.

It's high time to realize that this stalemate blocked the rights of both PRs & DRs just for the sake of playing to the gallery. It's pertinent to mention, even when BSNL proposed to end the stalemate after suffering considerable blows in the argument stages, some people executed the delay games and in the process they played with future and career of both PRs & DRs. Now it's clear that who have made the irreparable loss to those promotees who had to retire from 2011 to till date without achieving their promotions. The adament stand and delay from some corners, denied both DRs & PRs rightful due and in the process they made all the executives to suffer. Still instead of welcoming the judgment, the process of creating confusion has begun. SDE Cadre is having sufficient vacancies for all to be accommodated even if 1:1 is followed, but still the judgment is not being welcomed. With the implementation of this Judgment, all BRs up to 2007-2008 batch can become SDEs as most of the DRs till 2005 batch have been promoted as SDEs. The 50 percent of the remaining vacancies have the potential of accommodating all BRs who are elgible for promotion as per RRs and there is no clash as such between Promotees and DRs. Only thing that is needed is firm resolve to end this stalemate without playing any politics and without dancing to the galleries.

Its again wake-up call to all executive to realize WHO ARE FOR BRs and WHO USES THEM FOR NAMESAKE. It's a universal law that truth will always prevail and justice will be served to those who upholds truth.

Few days back, we mentioned Fact file showing vacancy positions & AIGETOA will strive to make sure that existing vacancies on SDE SCF would be filled by executing promotions to both type of executives SO THAT NO BODY SUFFERS.

Every DR is requested to spare their 10 minutes to read the submissions of AIGETOA which will throw light on how the rights of BSNL recruits are being compromised and there is an urgent need to unite together under single umbrella.

GS WRITES TO DIRECTOR (HR) SUBMITTING THE APPREHENSIONS OF BSNL RECRUITS:

GS writes to Director HR submitting the apprehensions of BSNL recruits. Our submission may give an impression that we are trying to stop the CPSU policy. But this is intended with an effort to make this policy rugged, litigation free and easily implementable.

Since, this policy is to be kept in public domain for 10 days before its implementation; it is very much needed to address the genuine grievances and apprehensions associated with the policy else the new policy will end up in litigations and court cases which ultimately will result into defeating the very purpose of the policy.

AIGETOA has always adopted a pragmatic & considerate approach for ensuring a contemporary CPSU hierarchy for the betterment of career prospects and meeting management's/company's need in this highly competitive environment. We want that the new policy which is going to be a landmark in the history of BSNL should be free from litigations and should be a strong one which cannot be challenged in court of law. All are requested to give 10 minutes of their precious time to read. This representation of AIGETOA is sufficient to prove that AIGETOA Is for all BRs irrespective of caste, creed, group or batch.

Ernakulam High court has disposed off in favour of the applicants (AIGETOA Team-Kerala)

It is learnt that court has directed to follow 1:1 with Promotees Vs Direct Recruits in JTO Cader. This has to be followed in seniority cum Fitness quota promotions for SDEs also where 50 percent of the SCF posts ie. 33.5 percent of the total posts will have to be reserved for DRs.

Details of the judgement is awaited. After 17 long years, Justice has been delivered to the BSNL recruits. We sincerely hope management will now take the justified step in favour of the BSNL recruits.


FACT FILE ON 1:1 SENIORITY CASE & CURRENT SITUATION ON SCF QUOTA PROMOTIONS

There are statements/queries from different corners with regard to the importance 1:1 seniority and its current beneficiaries / implications. The facts and situation should be aware to all BSNL Recruits in this regard. The DoPT Seniority case at Hon'ble High Cout Ernakulam is related with allotment of justified 1:1 seniority and settle other discrepancies like back dated YOR in JTO Seniority list, which had hamper BSNL recruits first career progression through SCF quota. 

AIGETOA's stand on Promotions is crystal clear that Promotions to be effected in Seniority and Competitive Quota for existing vacancies with existing Recruitment Rules. On persuasion of long pending promotions towards SDET cadre, AIGETOA work is only half done by executing the LDCE-15 promotions. Now the Promotions through SCF quota for the DRs with due seniority is awaited after Hon'ble High Court Kerala Judgement on the DoP&T case is pronounced.

SDET Vacancies & DRs eligibility of DRs for first career progression chances are mentioned in the below table so that all DRs should know where we stand.

From above table, it can be understood why we are insisting on filling up of all the available vacancies so that all the eligible JTOs can be promoted through existing RR itself.

The SAGA of claims and counter claims continue:

In the quest for claiming credit, people go up to which extent is visible on the website of one of our friendly association. They show that they are worried about pending promotions while the fact is that credit is more important than the work for them. While we love to work and deliver results, others make lot of hue and cry and result is nil. If they were so worried, why no body was aware about the Stay from Allahabad High Court as the case was almost two years old.

AIBSNLEA in its update has projected that the case is filed by AIGETOA while the fact is that when GM Pers informed about the Allahabad case, GS AIGETOA immediately enquired about the applicants, got in touch with them and convinced them to file withdrawal petition. This was well communicated to GS AIBSNLEA also along with others but still he preferred to unnecessary bother Director HR for the reasons best known to him. However, his web update also emboldens the fact that it was the efforts of AIGETOA which has made LDCE promotions a reality. Now we will make seniority cum Fitness promotions also a reality as we believe in growth of all without any prejudice and partisan attitude. With this thought in mind only, we tried consensus building amongst stakeholders in Ernakulam case in May 2017 but the same never took off despite our best efforts to end the stalemate.

We have already convinced the applicants in Allahabad case and they have withdrawn the case. Instead of appreciating the same, GS AIBSNLEA tried to falsely implicate AIGETOA name in it.

This credit thing is the main reason for this condition of promotional avenues in BSNL. Still no body wants to learn from it. It's high time for members to understand it now..

CPSU CADRE HIERARCHY APPROVED BY BSNL BOARD ON PROSPECTIVE DATE IMPLEMENTATION

Dear Friends

BSNL Board in its meeting held today afternoon at Hyderabad approved CPSU Cadre Hierarchy on prospective date i.e. date of notification of implementation. The CPSU Cadre Hierarchy implementation with prospective date is definitely a big loss, as all those who have not been promoted or who have been promoted just now shall be loosing 1.5 years. If the notification of policy goes beyond 1st July than the promotion will start from 1st January 2019 and effectively making it a two year loss. We will be taking stock of the situation and decide our next course. The benefits envisaged for the youngsters that they would get the promotion with 1.5 years service length is totally gone now. This is not at all acceptable to us.

The proposal as circulated earlier has been approved with slight changes like Non Functional Post of Joint DGM for executives in AGM grade getting E5-E6 scales, APAR grading based on Numerical Averages of Five years, Relaxation in Residency Period for those placed in higher scales, Board also directed to devise some benefit for Reserved Category Candidates which will be explored and submitted before notification of the policy. We have suggested for these changes and the same has found due favor.

Our suggestion for ensuring quota between LDCE and seniority Cum Fitness has been accepted and hence all SCF and LDCE candidates of same vacancy year shall be promoted together on same day. If SCF candidate of one vacancy year is promoted than LDCE candidate of the same vacancy years shall be promoted together irrespective of the number of years served and vice versa.

Time bound promotion will remain intact. Benchmarks remain the same as proposed earlier in circulated proposal.

However, our plea for incorporating qualification bar has not been accepted. Residency Period of 12 years remains unchanged and no weightage for qualification has been given in Residency Period. Fast track policy has not been discussed at all leading to murmurs of initiating MT recruitment. Management will have to come out clean on aspects like MT recruitment, Interchangeability of Responsibilities, Fast Track promotion policy for youngsters, and weightage of qualification. Even the service advantage of two years is gone now. These things will have to be taken care of and we will be shortly coming up with our next course of actions considering these aspects. We cannot allow any policy, which results into MT and loss for DRs.

As the CPSU policy will be from prospective date, in our opinion, existing vacancies will have to be filled up to ensure parity between all set of executives else anomaly may arise between those who have been promoted and those who have not been promoted leading to litigations. Parity between executives promoted through earlier RRs and Executives promoted though new Policy will always be legally challengeable.

The Seniority in JTO and AGM cadre need to issued or defined clearly before going to CPSU implementation, to avoid further litigations. At the same time, the JTOs who have completed 3 year regular service should be given with chance to get SDE vacancy years from 2012 to 2018, on eligibility basis under SCF / LDCE quotas, lest they will be put to disadvantage on non getting of promotions. Therefore, this intervening period should be utilized to execute all the pending promotions and filling up of all the vacancies.

The main concern of our pay scale change JTO-E2, SDE -E3 was also needed to be mapped to those cadre, as agreed to us, to minimize the pay loss. Now with DPE rejecting proposals of NTPC/NHPC for two different posts in same pay scale, it becomes an absolute necessity to upgrade the scales of JTO to E2 and SDE to E3 and doing away with non-functional scale of Senior SDE by merging Senior SDE scale with SDE Scale else scale degradation will be very much imminent as Cascading of Scales can never be implemented in BSNL keeping the financial condition of BSNL in mind and greater Pension liability of DoT. Now Merging of Sr. SDE scale with SDE scale is the only option to keep this CPSU policy flawless.

AIGETOA is the association who vouched for Contemporary CPSU hierarchy from year 2005 when others were completely against it. If it would have found due favor of management at that time perhaps all the HR anomalies in BSNL would have gone by now. However, we are happy that CPSU word has now going to become reality but to realize the same, genuine aspirations of BSNL recruits with respect to Qualification Bar, Executing all pending promotions to prevent further litigations, Deciding on the future of Senior SDE scales, Decision on Fast Track Policy, Clarity with regard to scrapping of MT RRs, Suitable relaxation in Residency Period for executives with professional qualifications, The work/job profiles of each cadre along with clarity on cluster reporting system, Doing away with the Interchangeability of Job responsibilities are the aspects which needs to be corrected immediately.

Executives may wonder, if AIGETOA was having so many objections than why it allowed this policy to be matured and go through. The fact is that we have been raising and submitting our objections but acceptance of the proposal was the first necessity. As per the policy, Management Committee itself can settle all above apprehensions of AIGETOA as the proposal empowers Management Committee of BSNL (Committee Consisting of Internal Directors of BSNL) to approve the changes based on requirement, which does not have any financial implications. AIGETOA has always believed in a pragmatic approach but the same should not come at the cost of benefits associated with Direct Recruits. We request our sister associations also to analyze these apprehensions and ensure the corrective action in advance to put in place a rugged and litigation free policy. AIGETOA is concerned and committed to open the reality and get the justified dues for BSNL recruits in the new policy implementation and we hope that now with the concurrence of BSNL Board on the CPSU policy, these genuine aspirations will definitely be taken care of by our sister associations.

AIGETOA always stood to expedite the promotions in SCF & LDCE quota at the earliest, so that the affected executives get the first promotion in their executive career span. AIGETOA is of the belief that all the promotions should be executed and accordingly, we have been following with the management for the same. Now with stalemate in promotion broken, we hope management will take all steps to ascertain that all eligible candidates for promotion from JTO to SDE gets their due promotion immediately. We tried to end the stalemate in May-June 2017 when we brought applicants and management came on meeting table and agreed upon promotion subject to filling up of all the available vacancies and seniority subject to the outcome of the court case. But some how things never moved forward despite having consensus. 

This is high time to take promotions on priority and ensure that promotions of all the eligible candidates takes place in both the quotas. If today CPSU hierarchy is approved, then its well and good else pending CPCs/LDCEs should be given highest priority.

Meeting with CGMT, BSNL Kerala at Circle office on 28/5/2018

An exclusive meeting with CGMT Kerala Dr. P T Mathew, ITS was held at Trivandrum on 28/05/18 and our association was represented by CP Sri Gireesh & CS Sri. Saheer. We wholeheartedly express our gratitude on behalf of whole LDCE cleared executives in Kerala for issuance of timely promotion orders. At the same time we have represented the genuine cases of change of BA allotment & other corrections in the promotion orders. Most of the cases including LKD, High range grounds & some specific BA changes were accepted by CGMT and orders issued accordingly . Remaining some requests , it was agreed to consider on completion of stipulated period.

Further we had discussed the matters of ill motived transfer at Kozhikkode, Look after arrangement in SDE / DE Caders, TBP of 2007,08 batches & Date change of earlier TBP, EPF related matters . In addition there was discussion regarding some operational matters along with revenue related with Kerala Circle.

CGMT assured us that the concerns will be given due consideration and followup.
